Privacy Policy
This privacy policy governs your use of the Soovu™ Pain Relief System Software Application (“App”) for mobile iOS and Android devices that was created by Soovu Labs Inc (“SLI”, “we”, “us”, or “our”). The App is designed to select, start and stop Heatwave Therapy provided by the wearable Soovu™ Heatwave Therapy Pod (“Pod”, or “Pods”). The App includes features to enhance the pain relief experience, such as meditative music and relaxation visuals, as well as help content for using the Soovu Pods.
HIPAA
The Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations restrict Soovu Labs Inc (“Soovu”, “SLI”, “Company”) from using and disclosing protected health information (PHI). For purposes of this Privacy Policy, the App does not knowingly collect or solicit PHI.
User Provided Information
The App obtains the information you provide when you download and register the App including your email address and password. Setting up your account with us is required to ensure secure access to your Pod(s), and to your personal Heatwave Therapy usage history.
We may also use the information you provide to us to contact you from time to time to provide you with important App and/or Pod update information, wellness information, and SLI-specific marketing promotions.
The App will prompt you for your perceived pain level following Heatwave Therapy sessions. The App will maintain a history of your responses both to enhance future performance of the Pod in providing more effective heatwave therapy, and to provide you with a visual means of tracking your pain management via your Soovu Pod(s).
When you set up your user account, you will be presented with the SLI Terms of Use statement that talks about the information the App will collect, as noted above. By accepting the Terms of Use you are agreeing to allow SLI, via the App, to collect this information (opt-in).
Automatically Collected Information
In addition, the App will collect certain information automatically, including, but not limited to, your Pod usage history (Heatwave Therapy settings, therapy session history, your treated pain location). Your Pod usage history is collected so that you can recall it at any time for personal use, and so that SLI can continuously improve the Pod’s clinical effectiveness.
The App will also collect your Pod’s unique device ID, the IP address of your mobile device, and your mobile operating system. This information is collected to make the App more convenient for your personal use by remembering the Soovu Pod(s) that are uniquely bonded with your mobile App, and to tailor the particular version of App software that will work on your mobile device.
Precise real time device location information
This App does not collect precise information about the location of your mobile device.
Third party access
The data collected by this App is not shared with any third parties, nor is access provided to any of the information obtained by the App to any third party.
The data collected by this App is stored in a secure cloud database provided by Amazon Web Services (AWS). Your personalized data that is stored in AWS is accessed only by you when requesting your usage history via the App.
SLI will aggregate your data with that of other Soovu Heatwave Therapy users after the collected data has been anonymized (personal information removed). The aggregated, anonymized data is statistically analyzed to help us improve the App and to improve the Heatwave Therapy algorithms. If SLI uses a third party to provide statistical analysis, we will update this Privacy Policy with applicable third party provider names.
We may disclose User Provided and Automatically Collected Information:
- as required by law, such as to comply with a subpoena, or similar legal process;
- when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request;
- if SLI is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Web site of any change in ownership or uses of this information, as well as any choices you may have regarding this information.
What are my opt-out rights?
You may elect to remove all personal information linking you to the collected therapy information that resides in the SLI cloud database. Following this action you will no longer be able to view your usage history.
At any time you may simply delete the App from your mobile device using the delete-application mechanism provided by the iOS or Android OS, which will uninstall the App and corresponding local data (to your device).
Data Retention Policy, Managing Your Information
We will retain your personal therapy history data for as long as you use the App, or until you have requested that data be deleted via the App. We will retain Automatically Collected information for as long as you use the App (which allows the App to remember you and your Soovu Pods), and will store it in aggregated form (anonymized) for the life of the SLI product (to help improve App performance, and to improve effectiveness of Heatwave Therapy algorithms).
Children
The App is contraindicated for use with children and we do not use the App to knowingly solicit data from, or market to, children under the age of 16. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at help@soovu.com. We will delete such information from our files as soon as possible.
Security
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our App. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
Changes
This Privacy Policy may be updated from time to time for any reason. We will notify you of any changes to our Privacy Policy by posting the new Privacy Policy here and informing you via email or via the About page of the App. You are advised to consult this Privacy Policy regularly for any changes, as continued use is deemed approval of all changes.
Your Consent
By using the App, you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us. "Processing,” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, and combining information, all of which activities will take place in the United States.
